Student loan debt is the only major kind of debt that can’t be wiped away through bankruptcy. This weird feature has made the crisis far worse than it needs to be, all because Congress got manipulated by special interests into eliminating crucial bankruptcy protections. The Student Borrower Bankruptcy Relief Act of 2019 would eliminate the section of the bankruptcy code (11 U.S.C. 523(a)(8)) that makes student loans non-dischargeable, allowing these loans to be treated like nearly all other forms of consumer debt.
